SOGO Auction Terms of Consignment Sale

Small machines of the same size and model that can fit in a container may be packaged in lots of 2 to 4 units at our discretion.
In such a case, the amount of (successful bid amount / number of machines) will be interpreted as one machine sold each, and each machine will be subject to the commission.
Exhibitors may not be allowed to exhibit depending on the model, size, or content of the machine. (e.g., parts, automobiles, generators, attachments, etc., or those with large or complicated attached parts)

Please submit the attached application form by fax or e-mail. Applications will be closed when the total number of applications reaches the specified number. When applying, please confirm with our staff that it is before the deadline. In principle, the maximum number of crawler cranes and mechanical truck cranes is 10 for the two-day event at Narita. The number of rough terrain cranes is limited to 60 in principle. Please send images of the machines you wish to exhibit to our staff. Depending on the condition of the machine, we may not be able to exhibit it due to safety reasons.

Procedure for Consignment Exhibition

Please fill out the required information and send it to us by fax or e-mail.

The form will be returned to you after confirmation and seal by our staff.

Carry in the exhibited machines to the auction site.
Please wash the machine and check the battery by yourself before delivery.

We will send you a fax confirming the contents of the list about 3 days before the auction. Please fax back to us as soon as possible after confirmation.

9 business days after the end of the auction, the calculation sheet will be faxed to the exhibitor ⇒ The exhibitor should confirm the contents and reply to us. ⇒ The next day (10 business days after the end of the auction) will be the payment date.

3. Exhibitable Machinery Requirements

  • ・The machine must have been manufactured within the last 25 years (some models may be older).

  • ・The machine must have been washed.

  • ・The machine must be in good working condition without requiring repair.


  • ・There are no missing parts. (e.g., bulldozers with missing blade attachment parts, hydraulic excavators with buckets or attachments that cannot be attached due to missing H-link or I-link parts, etc.)
    If it is determined that the above conditions are not met after the machine has been delivered, we will arrange for repairs to be made by a company designated by us. The exhibitor will be responsible for all repair and handling costs.
    (If it is judged that the machine cannot be repaired at least two weeks prior to the auction date, the machine must be taken back as soon as possible due to space constraints.) In addition, if any missing items are found even after the auction is over, the sale may become invalid.

  • ・If the product cannot be exported due to incomplete documentation, it cannot be exhibited.)


  • ・If the machine was originally designed for tunnel use, magnet use, or other special use, and has been modified by CAB replacement, painting, etc.
    If the machine has been modified to tunnel specification, magnet specification, or other special specification, such as CAB reloading, painting, etc., it must be indicated on the list or inspection sheet as 'USED IN TUNNEL BEFORE' so that bidders can easily understand the main use of the machine in the past.
    Also, although repainting machines are not prohibited, if deep corrosion inside the machine cannot be objectively determined due to putty or other hard coating, the machine may be deemed unacceptable. Please be sure to report this to us when you apply for consignment.
    If such modifications are revealed after the contract has been signed without reporting, the sale may become invalid.


  • ・Tampering with the hour meter and mileage meter is prohibited by law.
    If you know that the meter has been changed or tampered with in the past, you must notify us (the auctioneer) of that fact in advance. This will be indicated in the list or on the inspection sheet. The exhibitor shall be held responsible for any problems that may arise with the successful bidder due to tampering that is discovered after the auction.


  • ・Imported machines used overseas cannot be exhibited.
    If a machine is brought in without the knowledge that it is an imported machine and is judged by the Company to be an imported machine, the machine must be removed from the venue as soon as possible. Even if it is discovered after the contract has been signed, the sale will be subject to cancellation. In this case, fees will be charged as usual. In any case, the identification of imported machines will be left to the discretion of the Company.

  • ・If the machine is found to be defective even after the contract is signed, liquidation is completed, or export is completed, the sale will be cancelled.
    In the event that legal problems such as theft or remaining debt are discovered after the contract has been signed, the sale will be voided and a penalty of 20% of the winning bid price will be imposed on the exhibitor.
    Exhibitors are required to indicate on the consignment application form any other serious defects (malfunctioning of important parts, missing important parts, etc., to be determined by the Company) in the exhibited machines and vehicles.

4.Please refer to the attached document 'Terms and Conditions for Vehicle Inspection Certificates and Other Documents'.

Exhibit machines/vehicles/cranes/wheel loaders/road machines, etc. that can be driven on public roads.
The presence or absence of documents for vehicle inspection must be indicated on the application form. If the form is not filled out, the vehicle will automatically be listed as 'No Documents'.
Documents must be submitted to us within 8 days of the auction date. If there is an expiration date, it must be at least one month before the expiration date.

  • ・Exhibiting machines manufactured less than five years prior to the date of exhibition will not be allowed to exhibit without a certificate of transfer from the Construction Machinery Manufacturers Association.

  • ・The exhibitor shall be responsible for reissuing any documents that cannot be determined based on the documents (or copies of documents) submitted prior to the auction (e.g., expiration date of certificate of seal impression, non-payment of taxes, etc.) if such documents are discovered after the contract is concluded.

5. Carrying in machines to the venue

Exhibitors are required to bring in their machines by the deadline.
When arranging transportation, please be sure to send the attached 'SOGO Auction Site Procedures' to the shipping company.
Carry-in time (Mon. - Fri.) 8:30 a.m. - 4:00 p.m. Carry-in is not allowed on Saturdays, Sundays, and national holidays.
Please observe these hours strictly. (Lunch break: Noon - 1:00 p.m.)
Please be sure to bring the delivery slip (with the name of the consignor written on it) when you bring in the machines. (If we do not know the name of the exhibitor, we may not be able to accept your order.)
(If you do not know the name of the consignor, we may not be able to accept your package.) *Please turn off your engine in the designated parking lot (see attached map) before the 8:30 a.m. pickup begins or during the night.
Please do not park your car on the street.
If the blade is larger than the legal size (D6, D60P), be sure to remove it from the main unit before carrying it in. If there is any overflow of the width, it will not be accepted at the venue according to the guidance of the police.
Please make sure that there is no disturbance (noise, illegal parking, dumping of garbage, etc.) in the vicinity of the venue.

6. In the event that a car is judged to need washing or to have a defective battery

  • ・If the car needs to be washed or the battery is defective, our staff will arrange for the work to be done at the venue. The cost shall be automatically settled from the winning bid after the auction.
    Car washing is not allowed in the auction site during busy periods.
    The machine may have to be removed from the auction site and the car wash may have to be outsourced. In such a case, a round-trip fare to the car wash facility will be added separately, so please be sure to confirm that the car is washed before bringing it in.

7. Machines delivered with disassembled blades, cabins, etc.

Parts that have been removed and brought in will be installed at the venue before being displayed at the auction. The exhibitor will be responsible for the cost of the work.
The fee will be based on our regulations.

8. Exhibition of Vehicles

A copy of the vehicle inspection certificate must be submitted along with the vehicle application form.
Exhibits of vehicles are limited to the following sizes.
Dump truck up to 10t
Mixer truck up to 10t
Self-loader up to 10t
Flat-body truck up to 10t
*For other vehicles, please consult with our staff in charge in advance.

9. Principles of Bidding and Sales at Auctions

  • All exhibited machines will be sold at the highest bid price. No minimum price will be set.

  • Exhibitors (or related persons) are prohibited from bidding on and winning bids for their own exhibits.
    If such an act is discovered, a penalty of 20% of the winning bid will be imposed.

  • The ownership of the purchased goods shall be transferred to the successful bidder upon full payment to the Company after the conclusion of the contract.


  • If the auctioneer deems it unavoidable, the auctioneer may reauction a machine that was once sold. In this case, the auctioneer shall do so without obtaining the consent of the exhibitor.
    In the event of a re-auction, the price of the second or subsequent last auction shall be the winning bid.
    Any bid other than the last one will be invalid. 10.

Payment will be made 10 business days after the end of the last auction of the week. The day before the payment date, we will fax you the calculation sheet. Please check the contents, affix your seal, and fax it back to us.
This will serve as an invoice from the exhibitor to us. In the event that collection from the successful bidder is not possible due to unavoidable reasons, the contract may be invalidated after consultation.

11.The exhibitor's responsibility in the event of machine failure after the contract has been signed

Even after the contract has been signed (including after payment has been made to the exhibitor), the exhibitor will be responsible for the cost of basic power line malfunctions such as large oil leaks during loading and unloading from the venue or at the port, as well as minimal repairs. In such cases, the exhibitor will be invoiced separately after reporting the details, even if the invoice has been settled.
However, this will only apply if the defect is clearly difficult to detect during inspection.
The exhibitor will be responsible for the labor charges and the cost of new bolts if the bolts must be cut off due to rust or other reasons when disassembly is required to remove the blade or cabin.

12. Exclusion of Antisocial Forces

The Company reserves the right to refuse participation in the auction or cancel the participation or winning bid of any exhibitor or successful bidder, whether an individual or a group, without requiring any prior notice if the exhibitor or successful bidder falls under any of the following items. In this case, the Company shall not be obligated to compensate any damage to exhibitors or successful bidders, and exhibitors or successful bidders shall be obligated to compensate the Company for any damage incurred.
(1) If an exhibitor is or has been a member of a crime syndicate, a crime syndicate member, a crime syndicate quasi-constituent, a crime syndicate related enterprise, a general meeting of shareholders, a social movement advocate, or a special intelligent violent group, or any other person equivalent thereto (hereinafter referred to as anti-social forces).
(2) If antisocial forces are or are deemed to have been substantially involved in management.
(3) The company is or is deemed to have been used by antisocial forces.
(4) When it is recognized that the person is or was involved in providing funds or benefits to antisocial forces.
(5) If any employee, officer or person substantially involved in the management of the other party has or is deemed to have had a socially reprehensible relationship with antisocial forces.
(6) In the event that the User, by him/herself or by using a third party, engages in violent demands, unreasonable demands that go beyond legal responsibility, threatening words and actions, violence, spreading false rumors, damaging credibility by using false accounting or force, obstruction of business, or other similar acts.
(7) In the event that the User is or is deemed to have been engaged in an act that is offensive to public order and morals.

13. Disclaimer

The Company shall not be liable for any and all damages incurred by exhibitors and successful bidders in the case of interruption, delay, or impossibility of holding an auction caused by a natural disaster, an incident, other emergencies, or a failure in the facilities related to the Company's auctions.
Liability
However, the Company shall not be liable for any damage caused by abandoned machines or other machines without proper procedures, earthquakes, hail, heavy snow, floods, other natural disasters, or any other natural disasters for which the Company is not responsible.

14. Governing Law

The laws of Japan shall apply to the formation, validity, performance, and interpretation of this Agreement.

15. Consultation and Jurisdiction

Any matter not stipulated in these Terms and Conditions or any doubt arising in the interpretation thereof shall be settled through good faith consultation between the Company, the Exhibitor and the successful bidder. Transactions with the Company, operation, and other matters concerning this Agreement shall be construed in accordance with the laws of Japan, and if any dispute arises based on or in relation to this Agreement or the Auction, the Tokyo District Court or the Tokyo Summary Court shall be the exclusive agreed jurisdictional court of the first instance concerning such dispute.

16. Revision of this agreement

If the Company deems it necessary and appropriate for the operation of the Company, the Company may revise the Terms and Conditions by notifying exhibitors and successful bidders of the revised terms and conditions in a manner the Company deems appropriate, without obtaining the consent of the consignor or successful bidder. In this case, the rights and obligations of exhibitors and successful bidders and other conditions related to the operation and management of the Company shall be governed by the amended terms.
